Please read these Terms of Service carefully before using The Content Factory. By accessing or using our platform, you agree to be bound by these Terms.
By accessing or using The Content Factory platform at content-factory.zenithdigi.co.za ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Zenith Digital (Pty) Ltd ("we", "us", or "our"), a company registered in South Africa. If you do not agree to these Terms, you may not access or use the Platform. We reserve the right to update these Terms at any time. The Content Factory is an AI-powered social media content management platform that provides the following services: — AI-generated social media content creation (captions and images) for Facebook, Instagram, and LinkedIn — AI-powered content strategy generation and content calendar management — Scheduled content generation and automated publishing to connected social media accounts — Lead capture form generation integrated with Google Sheets — Multi-platform content management from a single dashboard The Platform is currently in beta and is made available free of charge during the beta period. We reserve the right to introduce pricing for continued use following the beta period, with advance notice to existing users.
Access to The Content Factory is currently by invitation only. To request access, you must submit a request through our website. We reserve the right to approve or decline access requests at our sole discretion. When you are granted access, you are responsible for: — Maintaining the confidentiality of your login credentials — All activity that occurs under your account — Notifying us immediately of any unauthorised access to your account at taahir@zenithdigi.co.za — Ensuring that all information you provide is accurate, current, and complete You may not share your account credentials with any other person. Each account is for the use of a single business entity.
The Content Factory integrates with third-party social media platforms including Facebook, Instagram, LinkedIn, and TikTok. By connecting these accounts, you: — Authorise us to access and publish content to those accounts on your behalf using the permissions you grant during the OAuth authentication process — Acknowledge that your use of those platforms remains subject to their respective terms of service and policies — Accept responsibility for ensuring that content published through our Platform complies with the terms of each social media platform — Understand that we store your OAuth access tokens in encrypted form solely for the purpose of providing publishing services You may disconnect any social media account at any time through your Settings page or directly through the respective platform's account settings.
You agree to use The Content Factory only for lawful purposes and in accordance with these Terms. You must not use the Platform to: — Publish content that violates any applicable laws or regulations — Infringe on the intellectual property, privacy, or other rights of any third party — Publish false, misleading, defamatory, or fraudulent content — Distribute spam, unsolicited communications, or malicious content — Violate the terms of service of any connected social media platform — Attempt to gain unauthorised access to our systems or any other user's account — Use our platform to scrape, harvest, or collect data from social media platforms in violation of their terms — Engage in any activity that disrupts or interferes with the operation of the Platform — Publish content that discriminates against, harasses, or harms any individual or group We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use terms.
Your Content You retain full ownership of all content you create, upload, or publish through The Content Factory, including prompts, brand assets, and published posts. Licence to Us By using our Platform, you grant Zenith Digital (Pty) Ltd a limited, non-exclusive, royalty-free licence to process, store, and use your content solely for the purpose of providing our services to you. We will not use your content for any other purpose, including training AI models, without your explicit consent. AI-Generated Content Content generated by our AI tools is created for your use. You are responsible for reviewing AI-generated content before publishing and ensuring it meets your standards and complies with applicable laws and platform policies. Third-Party Content You are solely responsible for ensuring you have the right to use any third-party content (images, text, trademarks) incorporated into content published through our Platform.
The Content Factory platform, including its design, software, features, and branding, is owned by Zenith Digital (Pty) Ltd and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Platform without our prior written consent. The Content Factory name, logo, and associated marks are trademarks of Zenith Digital (Pty) Ltd. Nothing in these Terms grants you any right to use our trademarks without prior written permission.
Your use of The Content Factory is subject to our Privacy Policy, available at https://content-factory.zenithdigi.co.za/privacy. By using our Platform, you consent to the collection and use of your personal information as described in the Privacy Policy. We comply with the Protection of Personal Information Act 4 of 2013 (POPIA) and take reasonable steps to protect your personal information.
The Content Factory integrates with third-party services including Meta (Facebook and Instagram), LinkedIn, TikTok, Google, and others. Your use of these integrations is subject to the terms and policies of each respective platform. We are not responsible for the actions, content, or policies of third-party platforms. If a third-party platform changes its API, policies, or functionality in a way that affects our services, we will make reasonable efforts to adapt but cannot guarantee uninterrupted service.
We will make reasonable efforts to ensure The Content Factory is available and functioning at all times. However, we do not guarantee uninterrupted or error-free service. The Platform may be temporarily unavailable due to maintenance, updates, or factors outside our control. We reserve the right to modify, suspend, or discontinue any feature or aspect of the Platform at any time with reasonable notice. During the beta period, features may change significantly as we develop the product.
To the maximum extent permitted by applicable law, Zenith Digital (Pty) Ltd shall not be liable for: — Any indirect, incidental, special, consequential, or punitive damages — Loss of profits, revenue, data, or business opportunities — Damages resulting from your use or inability to use the Platform — Damages resulting from unauthorised access to your account — Damages resulting from the actions of third-party social media platforms — Any content published through the Platform Our total liability to you for any claims arising from your use of The Content Factory shall not exceed the amount you paid us in the 12 months preceding the claim. During the beta period where the Platform is free of charge, our total liability is limited to ZAR 1,000. Nothing in these Terms limits our liability for fraud, wilful misconduct, or as otherwise required by applicable law.
You agree to indemnify, defend, and hold harmless Zenith Digital (Pty) Ltd and its directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: — Your use of the Platform — Your violation of these Terms — Content you publish through the Platform — Your violation of any third-party rights or platform terms — Your violation of any applicable laws or regulations
You may terminate your account at any time by contacting us at taahir@zenithdigi.co.za or through the account deletion option in Settings. We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or if continued access poses a risk to the Platform, other users, or third parties. Upon termination, your right to use the Platform ceases immediately. We will handle your data in accordance with our Privacy Policy and Data Deletion Policy.
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of The Content Factory shall be subject to the exclusive jurisdiction of the courts of South Africa. Before initiating any legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at taahir@zenithdigi.co.za. We will make good faith efforts to resolve disputes within 30 days.
